  • January 2023 Email Update

    Hello everyone! We have lots of good news and this will be lengthy, so please read through everything! We do have more neighbors who have joined the mailing list, so there is a little bit of recap to get them up to speed. LEGAL UPDATE From all the information and research submitted to Steve (attorney) he was able to put together an overview that was significant enough to support the activities of Dixie Shores Association going back the needed 20 years.  The court document has been completed and is being filed this week. This is to have our common areas deeded to the association so we have ownership of them as we have not been able to locate the current owners. This allows us to legally have control and authority over them for maintenance, future projects, and to keep the dock area private for our neighborhood. Steve provided the following to help clarify the time frame we’re looking at: File complaint Service by publication (4-5 weeks) Forty days after last publication for defendants to respond File affidavit of service by publication (ten days) Motion for entry of default judgement (thirty days) Unclear if court will require hearing on entry of default (thirty days?) So, assuming everything goes according to schedule, we should be done around June. This could slip a bit, depending on whether the Court requires a hearing and, if so, available hearing dates. We raised $10,000 as a retainer for Steve, and as of this email we have been billed $3,050 – so we have a balance of $6,950 at this time. BOARDS Based on the information above we’ll keep operating as Dixie Shores Association to maintain integrity until this is completed.  Once done, we’ll be able to merge Dixie Shores Association with Dixie Shores Community Association, Inc so that we are a registered nonprofit with the North Carolina’s Secretary of State’s office.  To recap the board members, they were voted in as follows: Dixie Shores Association President – Rose Hammer Vice President – Karen Nash Secretary – Merrie Foster Treasurer – Paul Foster Dixie Shores Community Association President – Amber Colburn Vice President – Dawn Morton Secretary – Chris Heivly Treasurer – Keith Textor A board for each entity is in place as they both have different roles to play at this time.  The Dixie Shores Association board is working with Steve through the legal process and assuring that we keep operating effectively to maintain our neighborhood.  The Dixie Shores Community Association board is putting in place the necessary operational structures and protocols needed for our new entity so that the merging of the two is seamless and we can keep right on going when it’s all done.  When we merge, the DSA board will step down and the DSCA board will take over. ROADS We had discovered last year that all roads in the Dixie Shores neighborhood are public roads and that once a minimum amount of residency is along each road, NCDOT will come in and maintain the roads.  These roads include Dogwood Place, Oak Drive, Cedar Road, Hickory Drive, Pine Lane, and Church Road. Right now, Dogwood Place is the only one that qualified with the residency and the paperwork has been submitted for NCDOT to approve.  They will come out and assess the road and then provide an overview of what they will do and when it will be scheduled.  Initially they will grade and gravel, but we will also be placed on a list to have them paved….albeit, that will be 10-20 years out as they have a queue of over 7,000 roads to be paved at this time. But this is good news for all of us as we now know there is a way to improve our side roads in the future without a cost to the neighborhood. BUDGET Attached you will find a copy of the 2023 Operating Budget for Dixie Shores Association.  Transparency and accountability are important for the association to provide and it gives all of us a better understanding of the costs associated with our neighborhood – whether they be fixed or discretionary – and how we can cover those costs.  Going forward this information will only be provided to members of the association, but because of the transition we’re going through, we felt it important that anyone who has ownership in Dixie Shores be provided a copy at this time. The budget is showing what we are projecting in membership fees and fundraisers to generate income.  How this number is derived will be explained in the Membership paragraph below.  The expenses shown cover the costs of our dock permit/fees, insurance, minimal lot maintenance and administrative costs.  No large repairs or maintenance items are reflected in the budget as those are topics of discussion for the Membership of Dixie Shores Association.  What the budget reflects is that if we have full participation of all ownership in Dixie Shores, we will cover our expenses and have $4,800 left over to put towards improvements! MEMBERSHIP – PLEASE READ AS WE’RE MAKING CHANGES!! Since we have established that we are not an HOA, nor ever can be, we are put in the position of understanding that our coming together as a neighborhood is not a requirement, but a privilege. Whereas other neighborhoods are forced to comply, we have the opportunity to work together and decide for ourselves what is most beneficial to all of us to improve and protect our neighborhood. To that end, the approach for the association needs to be revitalized. We have determined that while there are 617 lots, there are roughly 289 unique ownerships in the Dixie Shores neighborhood. This means most owners own more than one lot.  In 2022, 121 of those owners paid “dues”.  This equates to roughly 41% of the ownership in Dixie Shores. Based on our wanting to involve more neighbors, we are setting a goal of getting 80% of the ownership participating in 2023.  That would be 231 owners.  If we can hit 100% even better!  But we need to be realistic.  To make this obtainable for everyone and to encourage as much participation as possible, we have decided to change the approach to the “dues” that have been collected over the years.  Instead of paying dues per lot, we are going to change it to a Membership Fee per ownership.  An ownership can be a single individual, a married couple, multiple people, a trust, a business, etc.  The ownership itself is a single entity. Paying the annual Membership Fee will provide the following: Ownership will become a member of the association. Ownership may attend association meetings. Ownership will be a voting member of the association. Ownership will have access to the association website for communications, updates, events, and payments. For 2023 the Membership Fee is $40 per ownership.  It does not matter how many lots the ownership owns, they are only paying ONE annual Membership Fee to be a member of the Dixie Shores Association.  The goal is to get EVERY ownership participating and this approach simplifies the process and $40 is realistic for all of us. This is also what is captured in the 2023 budget for income.  The $11,560 shown would be if all 289 ownerships paid the $40 Membership Fee.  Even if only 80% of the ownerships paid (which is our goal – 231 owners), it would equate to $9,240, which is still sufficient to cover all the expenses and have some left over to improve the neighborhood.  That should be motivation for all of us! So, no more paying by lot(s).  The ownership of property in Dixie Shores, no matter how many lots they own or how many people are a part of the ownership, has the right to join the association by paying the $40 annual Membership Fee.  Going forward we will want the Membership Fees paid by January 15th of each new year, but we’re still making our way through this so if everyone will pay the fee by February 15th, that will get us rolling. FUNDS To supplement the Membership Fee and for those that want to contribute more financially to the Dixie Shores Association, we are setting up two funds.  One is a Dock Fund and the other is a Road Fund.  These monies will be designated specifically for repairs and maintenance to these areas and will not be used for anything else.  This allows owners to financially support what is important to them, knowing that those monies are going specifically to those areas.  When you send in your monies, if you are including more than the $40 Membership Fee, please let us know what fund you want the additional monies put into – and if both, how much in each one. For both Membership Fee and additional monies being contributed to either the Dock Fund or the Road Fund, you can send them to one of the following: Send them to Dixie Shores Association c/o Paul Foster, PO Box 4393, Greensboro, NC  27404 Send them to Dixie Shores Association c/o Rose Hammer, 291 N Shoreline Dr, New London, NC  28127. If you’re at the lake you can also drop them in Rose’s mailbox.  It is locked and secured. Just make sure to drop it in like mail and don’t leave it on the ledge where they pick up the mail! We are setting up a way to pay on the website, but this will not be active until we have merged the entities and are operating under a registered entity with an EIN.  Because we are documenting the Membership, you will be provided confirmation when your payment is received.  You will also get a prompt to sign up to access the website. If you don’t receive a confirmation in a timely manner, reach out to us so we can figure out what’s going on. Also, when sending in your monies, please include the following so we can continue to clean up the data: Name of legal ownership Lot numbers of lot(s) that are owned Physical address(es) of property in Dixie Shores if you have one Email address(es) of all individuals in ownership that want to be included in correspondences.  If you prefer to be communicated with by mail, please note that and include the mailing address(es) you want us to use. Emergency contact – name and phone number FUND COMMITTEES We need to form two committees to manage the funds.  Each committee will be responsible for determining what is needed in each area, prioritizing needed repairs or maintenance, getting bids, and reporting back to the membership.  If you would be interested in joining either the Dock Fund Committee or the Road Fund Committee, please let me know! Obviously, you will have to be a Member of the Dixie Shores Association to be on a committee. We would like to have these in place by our first meeting in April. WEBSITE While it is still a work in progress, we do have a live website!  www.dixieshores.org  This site will be accessible ONLY by Members of the Dixie Shores Association.  The public or owners that have not paid the Membership Fee cannot view anything other than the landing page.  You must be logged in to see and/or access anything.  Once the Membership Fee has been paid, you will be able to sign up and be approved for access.  This will be a great place for us to discuss our neighborhood, communicate, share information, store documents, meet neighbors, plan events and meetings, have committee updates, sell items, etc.  Eventually, you’ll also be able to renew your annual Membership Fee on there and contribute to the separate funds. ASSOCIATION MEETINGS Because of the changes noted above, going forward all DSA meetings will be for the Members of Dixie Shores Association only.  We will have a roster of paid memberships for those Members to sign off on to gain entry to the meeting.  If an ownership has not yet paid and would like to pay the $40 at the meeting to gain entry, we will be happy to accommodate that.  It will have to be cash though as we will have no means to process anything else at this time.  We trust everyone will understand and respect this so we can maintain the integrity of the association and the membership.   • July 2023 Meeting Notes

    Hi neighbors! Hope everyone is enjoying the sunshine and gearing up for a fun holiday weekend with friends and family! My initial thought was to not have the July meeting this year but was overruled by the other board members. (I'm smiling as I say that!) So while this is late notice, we will have a very short meeting this Saturday, July 1st, at 11am.  The Beauticians Lodge is not available as they had no one available to open it, so we'll hold the meeting outside.  (FYI, apple cider vinegar is great at warding off mosquitoes!  Just put it on like you would lotion.) We'll try to keep it under 30 minutes - will give a quick update, provide opportunity for questions, and allow more neighbors to join the association by paying the Membership Fee of $40. and/or contribute to either the Dock Fund or Road Fund. For those that can't make the meeting, I'm also providing the update below: Legal The Default Judgement has been filed and we're waiting on the courts response.  If they give us a thumbs up, we're done; but if they require a hearing, it will be August or later before our date is set.  As soon as we hear from the courts, you'll be the first to know!  We have $2,712.41 left in a legal retainer. Dock Thanks to Lisa Neal who responded to the last email that went out about needing an engineer!  She referred us to one, and Jonathan Leonard and the engineer are currently tweaking the plans for submission.  The connection saved the association over $1000K - thanks again Lisa!  Hopefully the plans will be in by next week for permit approval from the county and we'll be on our way to a new pier. Remember that we have floaters 36x48x16 ($50 each) and a 20' gangway and hardware ($2,500) for sale. These funds will go into the Dock Fund to help with the building of the new pier. Finances We currently have $6,593.99 in our account.  $3,258.00 of that is the Dock Fund and $155.00 of it is the Road Fund, leaving $3,180.99 in operational funds.  Our required Dock/Association insurance is due in July and the cost is $2,700.00. This means we have 480.99 left over to operate with.  Our electric bills are $40 per month, which equates to $240.00, leaving only another $240 to cover any additional expenses for the rest of the year.  It appears we will have to cancel maintenance of the dock area and our signage area on Blaine Rd unless someone would like to step up and take over it in a volunteer capacity.  We will also close the PO Box, and mail outs of information will no longer be an option (the cost of printing, paper, envelopes and stamps is not sustainable). This of course can change if more neighbors would join the Association.  Please make sure to let everyone know how important this is.  We can't do it without each other!   • Sept 2022 Meeting Notes and Elections

    Good afternoon everyone! Thank you to all that were able to attend the meeting earlier this month.  It was a great turn out - almost 50 people present, and not sure how many were online! The get together afterwards was also a lot of fun.  Thanks so Amber for all her hard work, and Kim for the beautiful set up! To help answer some questions that have been asked and make sure everyone has clarity on the two boards, we are sending out a recap on what was discussed, and decided on, regarding the legal progress and the elected board members: The checks for the $10K legal retainer fee were collected and turned over to the DSA Treasurer for deposit.  Vining Law has received the executed engagement letter along with the retainer. Thank you to all that pledged money to this cause - we are underway! Dixie Shores Association currently represents the neighborhood and will continue with those responsibilities until the legal process for the right of ways is completed and it is merged with DSCA. With the loss of both President and Vice President of DSA, voting was conducted to elect the replacement board members. This board is working with the attorney to help facilitate that process: President: Rose Hammer Vice President: Karen Nash Treasurer: Paul Foster Secretary: Mary Foster Dixie Shores Community Association, Inc, was registered recently with the NC Secretary of State to help us secure the insurance needed for the neighborhood and to allow us to begin to put in place the structures and protocols needed for us to operate more efficiently.  So while active and in place, DSCA is "standing in the wings" if you will, until the legal process is completed. At that time, when merged with DSA, DSCA will continue the forward movement, growth and participation in our neighborhood.  Voting was conducted and the following were elected to be the first board. They are actively putting things in place to help make a smooth transition when the time arrives: President: Amber Garlatz Vice President: Dawn Morton Treasurer: Keith Textor Secretary: Chris Heivly In speaking with Steve Vining, he has tasked the DSA board to provide as much supporting documentation as possible of activity going back at least 20 years.  If we can go back further, that's even more to our benefit.  For those neighbors who were past board members or participated in DSA in any manner over the decades, any information you can provide would be greatly appreciated. You are welcome to contact me directly with anything you may have.  Once we have gotten this info to Steve he will start the legal process.  He anticipates it taking about six months - from the time he receives the info - so we have an urgency to get this info to him!   • Fall 2022 Meeting Notes with Attorney to discuss issues

    This video is from a meeting held at Dixie Shores from Fall 2022. The following are notes to the neighborhood following the meeting with Steve from Sept to Nov 2022. Wanted to give a quick update.  Steve has reviewed the information and believes there is enough to sufficiently prove to the courts that DSA has been in existence as early as the 1960's.  He is updating his prepared filing to reflect some of the information he received and will have a draft for review by the end of this week.  We will review and comment and/or approve so we can get the filing to the courts.  I will confirm with everyone when that is done. Hi everyone, Wanted to get out an email to keep everyone up to speed on progress.  Steve Vining (attorney) has prepared the paperwork to submit to the courts, but before it can be entered, he is in need of as much information as possible supporting that DSA has been an association for a minimum of 20 years.  The farther back we can go the better.  Ideally, if we can connect the dots between Dixie Shores Corporation, Dixie Shores Realty Corporation and Dixie Shores Association, that would save a LOT of time and money. Paul and Merrie Foster, the current Treasurer and Secretary respectively, have copied documents from their records and sent a set last week to both Steve and myself. Once received Steve will go through them to determine if there is enough information to support our request of the courts. If not, we will have to keep digging. In the interim, any help from long term residents - those whose families have been here dating back to the 1950's - would be greatly appreciated.  But likewise, if anyone has any of the following information, please forward!  I'm also happy to come by and pick up anything you might have if that's easier. 1. Any documentation - can be emails, canceled checks, receipts, notices, minutes, contact lists, budgets, etc that go back at least 20 years and have to do with DSA. 2. Merrie was able to put together a list of board members going back to 1975. (Attached) Anyone who can fill in the blanks and/or go back even further, please let us know the names. 3. When was the sign at the dock installed and/or who installed it?  Any documentation supporting it. 4. When was the dock built and/or who built it? Any documentation supporting it. 5. Were roads ever repaired, dock ever repaired, right of ways ever cleared?  Any documentation supporting it. 6. Does anyone know the year that DSA was actually formed? Any documentation supporting it. 7. Does anyone know any person affiliated with Dixie Shores Corporation or Dixie Shores Realty Corporation?  Last names of known representatives were Rankin, Harris, Gorman, Wrenn, and Kelsey.  Maybe you know family members who could help with information.   • September 2023 - Dock Ownership Approval

    To all my precious neighbors – I’m am so happy to share the news that Dixie Shores Association now owns all our common areas! We have done it!! Steve, the attorney, shared the news and document with us yesterday.  The judge reviewed and approved our request.  Steve will now file the document with the county and we will move to merge Dixie Shores Association with our registered name Dixie Shores Community Association, Inc.  I anticipate that being completed within the next few weeks and Steve has confirmed that we can get the rest of this done with our remaining retainer monies, which are roughly $1,200. To that end, I want to personally take the time to thank, once again, all of you who stepped up to the plate and provided the funds to retain the attorney.  We could NOT have done it without you.  You filled a gap that the rest of us could not do at the time, and I thank you for your willingness and kindness to do so. This now puts us in a position to improve all our common lots (how exciting!!) and to enforce the private use of our dock area.  I trust this will also compel all neighbors who have not yet joined the association to do so, as all decisions about the common lots will be made by the members of the association through the voting process.  Let’s do this together! Other updates: Financial We are currently at 101 members in the association and it continues to climb.  There are 285 property owners out here, so we still have our work cut out for us.  That means only 35% of the owners are currently a part of the association – PLEASE talk to your neighbors and make sure everyone is joining.  It’s only an annual fee of $40 per ownership.  They can make a check payable to Dixie Shores Association and mail to 291 N Shoreline Dr, New London, NC 28127 or drop in the mailbox at that property as well.  It is a locked mailbox so it’s safe. (We have closed down the PO Box!!) We currently have $4,173.66 in our account.  $3,258 of that is designated for the Dock Fund and $355 is designated for the Road Fund, and a big shout out to Robert King for contributing $100 to help pay for our mowing service!!  This leaves a balance of $460.66 to cover the expenses of our neighborhood for the rest of the year.  We shut down the PO Box to have a small amount of monies returned to the association, but this will not be enough to cover the electric bills, domain/email service, and the mowing service for the rest of the year….so the mowing service will be next to go, unless more neighbors join.  It’s important for all property owners to know there is an actual expense for us to keep up our common areas and if we want to all enjoy them, we need to all participate! If every property owner paid the $40 membership fee each year we would be able to cover ALL the expenses for the association AND have over $6,000 to use towards improving our common areas….think about it. Dock Fund Committee We are still waiting on the engineer to make some final tweaks, and then the plans will be submitted to the county so we can get our new pier installed. Hoping to see that this week. Road Fund Committee We’re also still looking for people to volunteer for the Road Fund Committee! Dixie Shores Neighborhood FaceBook page I’ve had several people reach out to me concerning the DS neighborhood facebook page and it seems there is some confusion.  Please know that this FB page is not associated with the Dixie Shores Association at all.  It was created by one of our neighbors, Robert King, as a way for all neighbors to be able to communicate in a safe place.  (Thank you, Robert!) To this end he has taken great care to “screen” requests to join, making sure that only property owners are on there.  To be allowed access, he is requiring some questions to be answered that he can verify, BUT they must be answered completely in order for him to approve.  If you are aware of neighbors trying to get access, please help them understand this process and that it is not tied to the association. September Meeting Finally, it appears our meeting in September will be the transitioning meeting where the Dixie Shores Association board will step down and the Dixie Shores Community Association will take over. This will be an exciting meeting as we start to make decisions about our forward movement, and we need as many neighbors as possible to attend!  Please mark your calendars for September 2nd at 11am.  The meeting location is still to be determined, but we'll keep you posted.   • Oct 2023 New Dock Completed!

    Hi neighbors, I am coming to you with some wonderful news! The community dock that we all have been longing to see updated has officially been COMPLETED! I want to first start by singing continual praises to the dock committee. We are all so grateful for the hard work and dedication this group has put in to bringing this project to the finish line. If you see them around the neighborhood, please be sure to thank them for all that they have done! We could not have done it without them! Dock Commitee: Jonathan Leonard Jim Andrews Ivy Little Jay Pridgen Jackie Blackmon This topic has been an ongoing conversation for years, but we truly began making headway in April this year. September 2nd, 2023 marked the beginning of the tear down and we are elated to say that the inspections from Montgomery County were completed Oct 23rd, 2023 and we are officially back up and operational. I am truly amazed and inspired by the support both financially and physically from all of our fellow neighbors. Without each and every one of your contributions we would not have been able to make this happen, and in a relatively short amount of time. I think I speak for all of the DSCA board when I say thank you for all that you did (and do) to support this cause. We believe this project will be the catalyst for many projects to come in our continual improvement of the community. As a review, here is how the cost breakdown went for this build. Again, without Ivy, Jim and Jon this would have cost us MUCH more in labor! Thank you for helping us keep our costs low! Some neighbors have expressed interest in a celebration party to mark the completion of this monumental project. The board and I are in discussions about the logistics and best timing with the holidays in mind. Be on the lookout for an additional email update with more details on this celebration.   • Sept 2021 Meeting Notes

    Good day everyone The special meeting has been rescheduled for Saturday November 20th, 2021 at 11:00AM in the Beautician's Lodge on Church Street in Dixie Shores.  A few members have asked about attending via Zoom.  The building does not have WIFI and internet service in the building is spotty.  We will attempt to have Zoom available, but there is no guarantee it will be feasible.  The link is below if you'd like to try. Thanks Paul Foster Treasurer Good evening DSA Members At our Labor Day meeting, those in attendance suggested we schedule a special meeting to discuss ways of increasing property owner attendance in our meetings and encourage others to pay their dues. There is much in repairs and road maintenance that needs to be done, but due to a lack of funds, we are unable to.
